Acceptance of Terms

By accessing and using the PaddlerZone India website (the "Site"), you agree to comply with and be bound by these Terms & Conditions (the "Terms"). If you do not agree to these Terms, please do not use the Site.

Use of the Site

• Eligibility: You must be at least 18 years old to use the Site. By using the Site, you represent and warrant that you have the legal capacity to enter into these Terms
• User Account: To access certain features of the Site, you may be required to create an account. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.
• Prohibited Activities: You agree not to engage in any of the following prohibited activities: (a) copying, distributing, or disclosing any part of the Site in any medium; (b) using any automated system, including "robots," "spiders," or "offline readers," to access the Site; (c) transmitting spam, chain letters, or other unsolicited email; (d) attempting to interfere with the Site's network or security features; (e) using the Site for any illegal or unauthorized purpose.

Bookings and Payments

• Booking Policy: All bookings made through the Site are subject to availability and acceptance by PaddlerZone India. We reserve the right to refuse or cancel any booking at our discretion.
• Payment Terms: Prices for stays and activities are displayed on the Site and are subject to change without notice. Payment must be made at the time of booking using the provided payment methods. By providing payment information, you represent and warrant that you have the legal right to use the payment method provided.
• Cancellation and Refunds: Our cancellation and refund policy is as follows:
• The booking cost will be the 50% of the total payable amount of the activities chosen. Once the amount is paid the customer will receive a booking confirmation over email.
• The Customer will bear 50% of the booking amount as the cancellation fee, if cancelled 15 days prior the booking date.
• No refund will be made in case of cancelling 7 days prior the booking date.
• If the customer fails to reach the destination on the day of booking, no refund will be processed
• The refunds will be processed through original payment methods within 10 working days after cancellation.

Adventure Activities

• Assumption of Risk: By participating in any adventure activities offered through the Site, you acknowledge that these activities carry inherent risks and that you voluntarily assume all risks associated with participation.
• Release of Liability: You agree to release and hold harmless PaddlerZone India, its affiliates, and their respective officers, directors, employees, and agents from any and all claims, liabilities, damages, or expenses arising from or related to your participation in any adventure activities.

Intellectual Property Rights

• Ownership: The Site and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by PaddlerZone India, its licensors, or other providers of such material and are protected by Indian and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
• Limited License: You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Site for personal, non-commercial purposes. Any use of the Site not expressly permitted by these Terms is a breach of these Terms and may violate copyright, trademark, and other laws.

Disclaimers and Limitation of Liability

• Disclaimer of Warranties: The Site is provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
• Limitation of Liability: To the fullest extent permitted by law, PaddlerZone India shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use or inability to use the Site; (b) any unauthorized access to or use of our servers and/or any personal information stored therein; (c) any interruption or cessation of transmission to or from the Site; (d) any bugs, viruses, trojan horses, or the like that may be transmitted to or through the Site by any third party; (e) any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the Site.

Governing Law and Dispute Resolution

• Governing Law: These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.
• Dispute Resolution: Any disputes arising out of or relating to these Terms or your use of the Site shall be resolved through binding arbitration in [Shivpuri, Rishikesh, Uttarakhand], India, under the rules of the Indian Arbitration and Conciliation Act.
